I heard a bit about this then ran across this in depth, and long read, about it. If the plaintiff wins it could drastically change what we know as normal track day events.

Thoughts?

Its already been resolved and case thrown out. Video proof was key in this and the guy has now been black listed from most tracks.

Where did you hear it was resolved and thrown out? I’ve read several places there’s a trial scheduled for at earliest in May.

Interesting. That article is dated January 9th. Revzilla’s article is dated March 30th.

Also, the article in Monterey County names Kim's attorney as Robert J. Nelson and says Kim is planning to appeal the court's decision and "looking forward to trying a case against Keigwin's," which is set to take pace in May. Revzilla’s article says “Kim hired a serious San Francisco law firm — Leiff Cabraser Heimann & Bernstein. Leiff Cabraser et al assigned the case to a lawyer named Sarah London, who has a record of exacting big payments from powerful opponents. (She got a $3 million judgment from RJ Reynolds Tobacco for the family of a Florida smoker who died of lung cancer.)”. Suing a tobacco company and winning is no small feat.

The sandbags definitely reduced the chances of him making it through the off-track excursion unscathed, though you can't plan on someone running off everywhere. Right at the outside of the turn? Sure. (And I saw nothing there). But the turn was over. He could have made it, but he target fixated... first on the edge of the track, then on the sandbags.

We never want to see anyone get hurt, but dude, ya fucked up. Tell ya what. YOU pay the track day 5 million for screwing up, and they'll pay you 5 million for not moving the sandbag. Fair enough? :)
